Ilia's Terms of Service

By commissioning me, you automatically agree to the following terms of service below.

1. Overview

By commissioning me, you acknowledge you are over the age of 18. If the client is under 18, they are not allowed to commission me and their commission slot request will be rejected. If the client has worked with me and is found to be under the age of 18 at the time of the commission from start to finish, the client will end up getting blacklisted and will permanently end all business communications with them.I only work with clients with proven positive history of working with other artists. Clients must have at least 6 months of positive commissioning history with other artists, though 12 months is strongly preferred. Inquiries by empty and inactive accounts will be rejected. Clients must also have no negative commissioning history with other artists within the last 6 years. This involves a history of harassing other artists, filing unauthorised chargebacks, and breaching the terms of service of other artists.

1.1 Important Notes

As the artist, I reserve the right to refuse commissions I choose from anyone I choose for any reason. I can (and WILL) decline any works to anyone who is associated with alt-right hate groups. If you endorse any discriminative viewpoints against any race, religion, gender, nationality or sexuality, I will deny service and you will be blocked on sight as I refuse to work with such people.I'm also FIRMLY AGAINST cryptocurrencies and non-fungible tokens (NFTs). If you see any of my pieces sold as such on any platform, it's being done without my consent as an artist.I'm also FIRMLY AGAINST the use of generative AI, and I do not consent to my work being used to train them. As I don't support the use of generative AI, I will reject any commission inquiries from clients if I suspect they might use my work to train AI engines.

2. Payment Information

Payments are accepted via PayPal in United States Dollars (USD) only, with no exceptions. However, PayPal quickly does an exchange.Once a commission slot has been approved, I will not send an invoice until a rough WIP has been sent to and approved by the client.

2.1. Cancellations and Refunds

If for any reason the client isn't satisfied with the commission you decide to cancel the commission during progress, I can offer partial refunds in which the amount can vary, depending on how much progress has been made. I will calculate partial refunds based on how much progress has been made on the Commission via my Trello board. Commissions that have already been completed will not be refunded.If for any reason you want to cancel the commission before work the commission has started or before payments have been made, just let me know.If the client files an unauthorised chargeback against me, I will be forced to add a report on the client on ArtistsBeware and call them out on my socials for other artists to watch out for as it's a major breach of the ToS, and I will permanently end all business communications with them in the future.

3. The Commission Process

Once the client has sent a commission form and has been accepted, I will discuss with them any details they want in the project and how much the total price of the project is.Once everything with the commission is in order and once it's the client's turn, I will start working on an initial rough draft sketch of the commission to block out a rough idea of what the character pose and background would be like. At this point I will allow major changes to the artwork if the client wishes.Once the payment has been sent, I will start finishing the rest of the commission. I will carry on sending WIPs on the process of your commission to the client via their preferred method of communication. If an edit or revision is required in any commission; I’m willing to make minor edits/revisions to the drawing if I’ve made mistakes or anything that’s not wanted, e.g. wrong colour, etc. free of charge.If a client becomes rude or abusive during the commission process, I will cancel the commission, refund the client partially or fully depending on how much work has been done on the commission, will end communications with them permanently and possibly add a report on ArtistsBeware as I do not tolerate rude or abusive behaviour.Once the commission is completed, I will send the client the image files via their preferred method of communication in the form of a Dropbox link. I will send 2 copies of the artwork; one full resolution image of the commission and another with a 2k resolution for them to upload on their socials.If the client wishes to have edits made to the final piece of a project, I will make minor changes such as changing the colour of a certain area of a character or adding minor details free of charge, however if they want major changes to the final piece such as changing colour scheme of majority of character, adding details that weren't there before such as clothes and accessories of the character, I will do so for a fee.

4. Usage of Product

Once your commission is complete, I will allow the client to post the image to their galleries and their socials. When uploading the artwork that I've created, you agree to credit me as the artist and to link either my Bluesky or FA.I will also allow the client to use their commissioned artwork for other personal use such as getting the artwork printed and frames, or on a shirt for themself, or as a desktop wallpaper, or cropping it to be used as an icon/profile picture.As the artist, I reserve the right to post the completed artwork in my gallery and use it as an example for my future work as well as stream the process of the commission unless it’s explicitly stated on the form that the client wants the commission to be kept private.The client may NOT sell the image or use/reproduce it in a commercial way such as selling t-shirts with the artwork on it as prints without my permission to do so. The client may also NOT pay/hire another artist to edit the artwork in any way, which includes colouring or tracing for a new image. Regarding sketch commissions, the client may colour or ink the commission for their own personal use, as long as credit for the original is still given to me.As stated in 1.1., I refuse to have my work to be sold as NFTs or to be used for cryptocurrency or to train generative AI. If I discovering that a client has used their commission to be sold as NFTs or to be used for crypto or AI, they will get called out and blacklisted, revoking any more opportunities to any more future commissions from me and will end all business communications with them permanently.
